POST LD-2: PROPERTY OWNERS' RIGHTS.

Where have individual property rights gone? Much concern is expressed about the over development in Sevier County, and
the general defense is a private property owner can do with his land as he wishes. However, when a land owner desires to preserve privately owned land and refuses to sell to the government, the local and state governments tell him he is wrong and take his property through eminent domain. Short of breaking any laws, how can this issue be addressed and changed?

I believe legislation is needed to protect Tennessee property owners from the abuse of power of developers of real estate projects. An example of such legislation is the North Carolina Planned Community Act which prohibits developers from exempting themselves from paying their share of the common expenses of a planned community (for example, road maintenance dues).
